Is CBD legal in France?

Formal status

CBD classified as Novel Food since Jan 2019 (EU Regulation 2015/2283); no Union list authorisation exists for any CBD ingestible anywhere in the EU.

France's DGAL 2026 national control plan enforces this specifically against ingestible formats (oils, gummies, capsules, teas, drinks) - not against flower, resin, vape e-liquids, or topical cosmetics, which remain unaffected.

This is genuinely unsettled EU food law - no country has fully authorised CBD as an ingestible food supplement yet, and that's true everywhere we sell, not only France. We continue selling here because, based on what we can currently observe, enforcement action hasn't reached sellers shipping across borders the way we do - that's a real, monitored judgement call, not a claim that the position is settled or risk-free. We review this regularly and will update this page, and adjust where we ship, if that changes.

Outlook

Two things to watch. The merits case at the Conseil d'Etat is expected autumn 2026 - it could go either way; losing the emergency-suspension bid in July isn't a good sign but doesn't predict the merits outcome.

Separately, the European Commission's legal deadline to act on the ECHA Category 1B classification falls in August 2026. That deadline being reached doesn't mean an immediate change: any classification would be added to the CLP Regulation via an amendment that goes through member state consultation first, and industry bodies are actively challenging the classification and seeking a downgrade to Category 2. On current process timelines, nothing arising from this could take effect before mid-2027 at the earliest.
