Is CBN legal in Czechia?

Formal status

Across the EU, cannabinol is treated as an unauthorised novel food under Regulation (EU) 2015/2283 in the same way as CBD, and no Union list authorisation exists in any member state.

In Czechia, cannabinol is named nowhere in national law. It does not appear in the schedules of addictive substances, it does not appear in the list of scheduled psychoactive substances adopted in January 2025, and it does not appear in the food supplements decree - neither among permitted substances with maximum daily doses nor among prohibited ones.

What catches it is the same statutory novel food prohibition that catches CBD. Since 1 April 2025, section 10(5) of the Food Act prohibits placing on the market any food carrying novel food status in the European Commission's catalogue, and cannabinoids carry that status as a class. The prohibition operates by reference to the catalogue rather than by naming any particular cannabinoid, so it reaches cannabinol without ever mentioning it.

Cannabinol's only other Czech exposure is as a constituent of a cannabis extract or tincture, which is excluded from the definition of an addictive substance where it contains no more than 1% THC.

Yes, we ship to Czechia. Czech law does not mention cannabinol anywhere - not in its narcotics schedules, not in its list of controlled psychoactive substances, and not in its food supplement rules.

That is not the same as it being authorised. Since April 2025 Czechia has written the European novel food catalogue directly into its Food Act, and because cannabinoids sit on that catalogue as a class, the rule reaches cannabinol without naming it. So the formal position is the same as for CBD.

Outlook

Cannabinol has no independent Czech story. It follows the novel food catalogue, and would be released by an EU authorisation in exactly the way CBD would - automatically, because the Czech prohibition operates by reference rather than by name.

The risk worth watching is the reverse. Czechia has shown itself willing to add cannabinoids to its psychoactive-substances schedule quickly: that list already covers a long series of semi-synthetic and minor cannabinoids, and it grew again during 2025. Cannabinol is not on it and nothing suggests it is a candidate, but the mechanism for adding one is well established and moves faster than food law does.

Timeline

August 2022

Zákon č. 247/2022 Sb., published 31 August 2022 and in force 1 October 2022, inserts §§ 3b–3d into zákon č. 146/2002 Sb. SZPI may enter a website on a published register by administrative decision under § 3c(1), with the site's operator as a named party and a right of appeal; where the operator cannot be identified they are designated as the domain-name holder and served by public notice. Under § 3d, providers of internet access in Czechia must then block the listed site within 15 days.

February 2025

Zákon č. 70/2025 Sb. of 26 February 2025 inserts § 10(5) into the Food Act (zákon č. 110/1997 Sb.): "Na trh je dále zakázáno uvádět potraviny uvedené v seznamu Evropské komise 'EU Novel Food Status Catalogue' se statusem 'novel food'…". In force 1 April 2025. Breach is an offence under § 17(2)(k) carrying a fine of up to CZK 10,000,000 under § 17f(c), heard by SZPI inspectorates. Czechia appears to be the only Member State to give the Commission's Novel Food Catalogue direct statutory binding force.

November 2025

SZPI enters a "CANNABIS OIL" website (ref. W25-000014-SZPI-CZ) on its register of non-compliant food websites, but does not block it. The entry records that the site is registered outside Czechia, that the domain holder cannot be identified, that hosting is in the USA, and that "aktivity českých dozorových orgánů vůči provozovateli těchto webových stránek jsou velmi omezené". The product was promoted as normalising blood sugar, cholesterol, immunity and sleep.
