Is CBN legal in Sweden?

Formal status

Across the EU, cannabinoid extracts including cannabinol are classified as unauthorised novel foods under Regulation (EU) 2015/2283, and no Union list authorisation exists in any member state. The Swedish food authority's wording covers cannabinoids as a class, so cannabinol has no lawful food route.

Cannabinol is not itself a controlled substance in Sweden. It is named in none of the Swedish narcotics schedules and is not on the list of substances hazardous to health, and the national public health agency's register of substances under investigation does not include it. The Swedish schedules do control a long list of tetrahydrocannabinol isomers and semi-synthetic derivatives, and recent amendments through 2026 have continued adding to that family, but cannabinol is not among them.

That leaves cannabinol in Sweden governed by two mechanisms rather than by any entry of its own. The first is the 2019 Supreme Court holding that a preparation containing THC is narcotics regardless of concentration - which is a rule about the preparation, not about the headline cannabinoid, and so catches a cannabinol extract carrying trace THC exactly as it catches a CBD one. The second is medicines classification: the medicines agency treats orally taken cannabinoid products with pharmacological effect as medicinal products, and a sleep-positioned cannabinol product sits squarely in that assessment.

Cannabinol is not itself a controlled substance in Sweden. That does not help us, because Sweden's 2019 Supreme Court ruling is about the preparation rather than the named cannabinoid: any extract containing THC is treated as a narcotic, at any concentration, and Swedish law sets no permitted level.

Outlook

Sweden has been adding cannabinoid derivatives to its schedules steadily, most recently in late 2025 and mid 2026, so amendment risk is live even though cannabinol has stayed outside every sweep so far and is not currently under investigation.

That risk is largely academic for us while the position on the preparation and the cross-border enforcement record stand as they do. Nothing about a cannabinol listing would change our assessment; its absence does not soften it.

Timeline

June 2019

Högsta domstolen holds that CBD oil containing THC is narkotika under section 8 of the narcotics criminal act, even though the THC derives from lawful industrial hemp. The industrial-hemp exemption does not reach preparations, and the THC concentration in the case could not be determined (NJA 2019 s. 531, mål B 177-19).

Läkemedelsverket prohibits Glowing Pine B.V., established in the Netherlands, from selling CBD oils, capsules and any oral cannabidiol preparation from hemp extract in all strengths to customers with addresses in Sweden, under a continuous penalty of SEK 600,000. A parallel decision issued the same day against a second Netherlands company.

Förvaltningsrätten i Uppsala upholds Läkemedelsverket's prohibition on a Netherlands company selling CBD products to customers in Sweden, holding that a medicine sold in Sweden must be authorised in Sweden even where the sale is made over the internet, and rejecting the argument that the e-commerce directive exempts cross-border online sellers (mål nr 1702-21).
