Is CBN legal in Poland?

Across the EU, CBN is classified as an unauthorised novel food under Regulation (EU) 2015/2283 in the same way as CBD, and no Union list authorisation exists in any member state. Cannabinol has no EFSA safety opinion of its own.

Cannabinol is not scheduled in Poland. It is named nowhere in the groups of narcotic drugs, psychotropic substances or new psychoactive substances, and neither are cannabigerol or cannabichromene. There is no cannabinol inversion here of the kind seen in Ireland, Latvia and Great Britain, where cannabinol is the controlling entry and CBD inherits from it. In Poland both cannabinoids inherit from the same cannabis material entry, and both fall outside it when the source material is compliant fibrous hemp.

That entry, in the Minister of Health regulation that has carried Poland's schedules since 2018, covers cannabis herb other than fibrous together with extracts, pharmaceutical tinctures and all other extracts from cannabis other than fibrous. The qualifier appears twice, once on the herb and once on the extracts, so a cannabinol-bearing extract from hemp meeting the statutory 0.3 per cent definition is not caught.

What constrains a cannabinol supplement in Poland is food law. The chief sanitary inspectorate treats cannabinoids in food as unauthorised novel food and has issued public warnings and withdrawal orders against Polish companies on that basis, generally alongside an objection to THC content. The Supreme Administrative Court has separately criticised the inspectorate for treating the Novel Food Catalogue as binding, in a case about hemp herb rather than extracts.

Cannabinol is not a controlled substance in Poland. It appears in none of the country's drug schedules, and unlike a few European countries Poland has not singled it out for separate treatment from CBD. What Poland schedules is cannabis material other than fibrous hemp, and the exclusion covers extracts as well as plant material.

As everywhere in the EU, cannabinol has not yet been authorised as a novel food, and Poland's sanitary inspectorate has acted against Polish companies selling hemp supplements. That enforcement has reached businesses established in Poland rather than sellers shipping in from elsewhere in the EU.

Outlook

Cannabinol is often added to national schedules separately from CBD and later than it, as Latvia did with effect from December 2025. Poland has not done so and has shown no sign of doing so; its recent scheduling activity has gone to synthetic and semi-synthetic cannabinoids instead, most recently two THCP derivatives in July 2026.

The development most likely to matter is judicial rather than legislative: whether the Supreme Administrative Court's reasoning about the Novel Food Catalogue, given in a case about hemp herb, is ever extended to extracts.
