Is THC legal in Latvia?

EU law sets a 0.3% delta-9-THC threshold for industrial hemp varieties under Regulation (EU) 2021/2115, applied in Latvia through the THC monitoring requirement in Cabinet Regulation No. 198 of 18 April 2023. That figure attaches to the crop in the field and to eligibility for direct payments.

Latvia sets no THC threshold for finished products at all. Delta-9-THC is listed as dronabinol in List II of the annex to the likums Par Krimināllikuma spēkā stāšanās un piemērošanas kārtību; cannabis and, expressly, kanabisa sveķi, eļļa, ekstrakti un tinktūras - cannabis resin, oil, extracts and tinctures - are in List I, as is any mixture containing dronabinol jebkurā daudzumā, in any quantity. The State Agency of Medicines stated the position directly on 9 September 2022: the legislation sets no minimum quantity from which a substance begins to be controlled, so any amount of delta-9-THC is subject to control, and the 0.2% figure does not attach to products because it is set for hemp growing in fields so that farmers can receive area payments.

Article 5 of the law on legal circulation prohibits importing, transporting, distributing or sending through Latvian territory anything in List I, and article 39(3) separately provides that natural persons may not send or receive List II or III medicines by domestic or international post. The food and veterinary service confirmed on 25 June 2024 that hemp flowers may not be used in food, including herbal teas.

Latvia sets no permitted level of THC in finished products at all. Its medicines agency has stated plainly that the law fixes no minimum quantity from which control begins, so any amount is controlled, and that the 0.2% figure people often quote belongs to hemp growing in fields rather than to products on a shelf. Cannabis extracts and oils are separately prohibited in their own right.

Outlook

Latvia's zero-tolerance position on THC in products is long-standing, clearly stated by the medicines agency, and shows no sign of moving.

It combines an ordinary EU cultivation threshold with a national rule that recognises no product-level tolerance at all, and that combination has been stable for years. We do not expect it to change.
