Is THC legal in Denmark?

At EU level the reference figure for hemp is 0.3 per cent THC, set for agricultural purposes by Regulation (EU) 2021/2115, and separate maximum levels apply to hemp seed foods as contaminants.

Denmark operates two thresholds at once, and they sit at very different levels.

The narcotics threshold is comparatively permissive. The current order on euphoriant substances, BEK nr 405 af 26/03/2026, in force since 29 March 2026, lists cannabis and tetrahydrocannabinol, but paragraph 1(3)(7) places outside the order any hemp drug and any preparation of it containing no more than 0.2 per cent THC. Preparations are expansively defined to include solutions, dilutions, extracts, concentrates, tinctures and pharmaceutical preparations of any kind. A finished hemp extract at or below 0.2 per cent therefore sits outside Danish narcotics law altogether - a materially more permissive position than Sweden or Finland, neither of which has any threshold.

The food threshold is much tighter, and it is expressed as a mass per dose rather than as a percentage. The Danish food authority's guideline action limits, set in June 2018, provide that the recommended daily dose of a food supplement may contain at most 80 micrograms of THC and at most 200 micrograms of total THC, and state expressly that these apply at finished-product level rather than to intermediate ingredients. The framework was applied in August 2023, when the national food institute assessed five CBD oils against it for the food authority and found all five exceeded it at their stated dosing.

Separate finished-product limits apply to hemp leaf tea, and EU contaminant maxima apply to hemp seed products.

Denmark's approach to THC is more nuanced than most. For narcotics purposes it treats hemp preparations containing no more than 0.2 per cent THC as outside its controlled substances rules altogether, which is more accommodating than Sweden or Finland, neither of which permits any level at all. Separately, its food authority has set guideline limits for THC in food supplements expressed as micrograms per daily dose rather than as a percentage, applied to the finished product.

Every batch we sell is third-party tested and the results published, and our tested THC content sits comfortably below 0.2 per cent. We do not sell a batch that does not clear our own release testing, which is the gate that matters before any national threshold does.

Outlook

The point to watch is the current standing of the 2018 food supplement action limits. They were applied as live in 2023, but the food authority's present published page on THC sets out only its hemp tea and hemp seed limits and does not restate the supplement figure. The likeliest explanation is structural rather than substantive - a cannabinoid supplement is an unauthorised novel food and so has no lawful population for an action limit to govern - but we have not been able to confirm that, and a written enquiry would settle it.

We do not expect the narcotics threshold to move. It has been in place since 2018 and Denmark's neighbours have expressly declined to copy it.

DTU Fødevareinstituttet assesses five 10 ml CBD oils for Fødevarestyrelsen following a European rapid-alert notification, and finds that all five present a health risk to consumers if taken orally at the dosing the company describes, because the resulting THC intake exceeds the national guideline action limits for food supplements.

Denmark issues a new consolidated order on euphoriant substances, BEK nr 405 af 26/03/2026, in force 29 March 2026 and repealing the 2021 order. Cannabis is liste B nr. 83 and tetrahydrocannabinol is separately listed. Paragraph 1(3)(7) continues to place outside narcotics law any hemp drug and any preparation of it containing no more than 0.2 per cent tetrahydrocannabinol, with preparations expansively defined to include solutions, dilutions, extracts, concentrates and tinctures.
