Is THC legal in Slovakia?

Slovakia restructured its drug offences in August 2024, and personal possession is still a crime rather than an administrative matter. Holding up to two grams of cannabis carries up to a year, and growing up to two plants for yourself is a separate offence carrying up to six months. There is no medical cannabis at all, since cannabis sits in a schedule reserved for substances with no medicinal use. Slovak drug law contains no THC percentage anywhere.

Slovakia handles hemp differently from most of Europe. Its drug law contains no THC percentage at all. Instead of setting a number, it exempts cannabis material grown from registered hemp varieties listed in the EU catalogue, which is what our extract is made from.

That means the question in Slovakia is where the plant came from rather than what the laboratory number says. We test every batch for cannabinoid content and publish the results anyway, because most other countries do work to a number.

Slovakia schedules THC itself, along with a growing list of synthetic and semi-synthetic cannabinoids that we do not use. In one documented case a Slovak prosecutor declined to bring charges over cannabinoid products testing well above our own levels.

Perspectivas

Slovakia has added minor and semi-synthetic cannabinoids to its schedules once already and created a separate risk substance category at the same time, so further individual additions are likely. That process has consistently named new synthetic and semi-synthetic compounds rather than touching naturally occurring hemp constituents.

Because the Slovak exemption is varietal rather than numerical, what protects a hemp product here is the documented provenance of the plant rather than a laboratory number. The question to keep answered is which registered variety the material comes from.

No Slovak court has yet construed the material entries against a low-THC hemp extract. A first judgment would be significant, and there is one prosecutorial decision pointing in a helpful direction already.
