Is THC legal in Ireland?

Cannabis remains a criminal offence in Ireland, though a first or second possession charge carries a fine rather than prison, and a health referral scheme diverting first-time possession to the health service has been announced for September 2026, after earlier target dates were repeatedly missed. Growing a single plant still carries up to fourteen years. Medical access covers three conditions and has enrolled 75 patients since 2019. Ireland sets no THC threshold for food at all.

Ireland is one of the strictest countries in Europe on this point. It sets no permitted level of THC in food at all - not 0.2%, not 0.3%, none - and the Irish courts have confirmed twice that any product containing THC in any proportion is a controlled drug there.

Perspectivas

The Irish position is settled rather than shifting, and the legal avenues for challenging it have been tried and closed. A free-movement challenge under EU law failed twice at first instance and once on appeal, with a reference to the Court of Justice refused, and the reasoning now rests partly on the parties to the Single Convention rejecting a proposed 0.2% exclusion in December 2020.

A change would most plausibly come from the EU rather than from Dublin, and nothing of the kind is close.
