Is THC legal in Sweden?

Sweden criminalises consumption itself, which is unusual, so using cannabis is an offence in its own right alongside possession, and growing is prosecuted as manufacture. A 2023 government inquiry into drug policy did not propose decriminalisation and nothing has been legislated from it. Medical use is minimal, with Sativex authorised but unreimbursed and flower reaching only a small number of patients by individual licence. Sweden deliberately sets no THC concentration limit for preparations.

Most European countries work to a THC threshold, usually 0.2 or 0.3 per cent. Sweden does not have one, and that is a deliberate choice - it considered introducing one and decided against it. Its Supreme Court ruled in 2019 that a CBD preparation containing THC is a narcotic whatever the amount, in a case where the amount was too small to measure, and involving a private individual who had simply bought the oil online as a supplement.

Our products are third-party tested and test well under 0.2 per cent. In Sweden that is beside the point, because the test is whether THC is present at all rather than how much. Combined with Sweden's record of ordering foreign online sellers to stop supplying Swedish customers, it is not a market we can serve.

Perspectivas

Sweden has twice declined to introduce a THC threshold for preparations, as set out above, and we do not expect movement.

The practical trend to watch is in the opposite direction from most countries: Swedish customs has publicly sought broader powers over consignments arriving from other EU member states, which it currently lacks. If that changed, the gap between Sweden's formal position and its border reach would narrow considerably.

June 2019

Högsta domstolen holds that CBD oil containing THC is narkotika under section 8 of the narcotics criminal act, even though the THC derives from lawful industrial hemp. The industrial-hemp exemption does not reach preparations, and the THC concentration in the case could not be determined (NJA 2019 s. 531, mål B 177-19).
