Is THC legal in Finland?

Cannabis is fully controlled in Finland. Use and small-scale possession are a criminal offence normally dealt with by a police-issued fine, and growing your own is the more serious offence, carrying up to two years. A 2019 citizens' initiative for decriminalisation was rejected by parliament in 2022 and nothing has changed since. Medical cannabis exists only by individual Fimea licence and is not reimbursed. Finland sets no THC threshold for finished products at all.

Finland is stricter than most of Europe here: it sets no permitted THC level at all, where EU agricultural rules use 0.3 per cent and several member states apply that figure to finished products. Finnish law lists cannabis extracts without a hemp exception, and in 2023 the Supreme Court upheld convictions involving material testing at 0.2 to 0.3 per cent.

Our own batches are third-party tested and published, and test meaningfully below 0.2 per cent. We are not relying on a threshold to be comfortable in Finland; we are relying on the fact that Finnish enforcement in this area has been directed at businesses operating inside Finland, and that comparable EU sellers deliver there without impediment.

Perspectivas

A case has been reported as pending before Finland's Supreme Court on whether low-THC cannabis material is a narcotic under the criminal code. We have not been able to confirm it from the court's own records, so it is not recorded in the timeline, but it is the single most consequential thing on the Finnish horizon for this ingredient. A ruling in either direction would settle a question that currently rests on a 2023 precedent about flower rather than about finished supplements.

Short of that, we do not expect Finland to introduce a tolerance figure. It has had ample opportunity and has consistently declined to.

Korkein oikeus upholds narcotics convictions for postal importation and onward supply of cannabis flower testing between 0.2 and 0.3 per cent THC, and raises the sentences from fines to conditional imprisonment. The recipient of four postal consignments was among those convicted (KKO:2023:94).
