No EU member state has authorised CBD as a novel food. That's been the position since January 2019, when Regulation (EU) 2015/2283 brought CBD ingestibles under novel food law. EFSA's February 2026 provisional safe intake figure (roughly 2mg/day for a 70kg adult) is a safety opinion, not an authorisation.

Estonia does not schedule CBD. Cannabidiol appears nowhere in the Estonian narcotic and psychotropic substance schedules, verified against the annex substituted in full with effect from 14 August 2026. The schedules do list cannabis and its processing products, expressly including extracts and tinctures, but the entry carves out varieties on the EU common catalogue of agricultural plant species with a THC content not exceeding 0.3 per cent. The State Agency of Medicines reads that carve-out as carrying through to the extract: CBD as a substance is not on the list, and CBD is deemed narcotic only where it has been obtained by extraction from narcotic cannabis. Text and regulator practice agree, which is not true everywhere.

What Estonia does prohibit is selling CBD as food. The Agriculture and Food Board holds that CBD and hemp extracts are prohibited novel foods and may not be marketed as food or as food supplements.

The same authority has also published, in its own guidance, that it cannot restrict a consumer ordering food or food supplements from the internet for personal use, because the Estonian Food Act does not apply to activities intended for one's own consumption, and that no maximum quantity for personal use has been set.

Estonia does not treat CBD as a controlled substance. Cannabidiol is not on the Estonian narcotics schedules, and the State Agency of Medicines has said so directly, treating CBD as narcotic only where it has been extracted from narcotic cannabis rather than from approved industrial hemp. Ours is not.

Estonia does hold that CBD cannot be sold as a food or food supplement, because of the same EU novel food classification that applies everywhere we sell. No company anywhere in the EU holds the authorisation that would settle it. Estonian enforcement of that position has consisted of letters to sellers within Estonia, and we found no Estonian action against a seller established in another member state.

One thing worth knowing if you order from abroad generally: Estonian customs actively examines parcels for controlled substances, and has been public about it. The substances they name are ones Estonia schedules - synthetic cannabinoids and high-THC products - rather than compliant hemp extract. We publish third-party testing for every batch so there is never a question about what is in ours.

Perspectivas

Estonia's food-law objection to CBD is the standard EU novel food position, and an authorisation at EU level would resolve it without any Estonian step. The narcotics side is already favourable and the medicines agency restated it in July 2025, so the formal picture is unlikely to move against us on its own.

The development actually worth watching is at the border rather than in the law. Estonian customs runs an active programme against cannabinoid products ordered from foreign online shops, reported in August 2026 with hundreds of cases across 2025 and the first half of 2026. Every substance the authority named is one Estonia schedules - synthetic cannabinoids and high-THC products - rather than compliant hemp extract, but it means Estonian consumer parcels are being looked at closely, and how a product is described matters.

April 2022

The Estonian Agriculture and Food Board announces that CBD-containing foods may not be sold as unauthorised novel foods, writes to every seller known to it, and states it may issue precepts backed by coercive penalties of up to 9,600 euros.

The food regulator states that prohibited CBD products continue to reach the Estonian market, mostly from third countries, and refers advertising concerns to the consumer protection authority; no seizures, fines or product counts are reported.

The State Agency of Medicines publishes its current position that CBD is not itself a listed narcotic or psychotropic substance, and is treated as narcotic only where it has been extracted from narcotic cannabis, hemp on the EU common catalogue at up to 0.3% THC not being narcotic.

The Tax and Customs Board reports 381 narcotics and psychotropics violations in postal and courier consignments in 2025 and 222 in the first half of 2026, names Spain among the main dispatch countries, and warns that ordering products marketed as legal elsewhere can expose the recipient to criminal liability.
