Is THC legal in Czechia?

Czechia part-legalised cannabis on 1 January 2026. Adults over 21 may grow three plants and keep 100g at home or 25g in public, but sale remains criminal and no regulated market was created. Medical cannabis has been prescribed through pharmacies since 2013 and is 90% reimbursed. For food there is still no permitted amount of THC: the 1% figure applies to the plant a producer may use, not to the finished product.

Czechia is the most permissive country in the European Union on this point. Since 2022 a hemp extract containing up to 1% THC is not treated as a controlled substance at all - more than five times the common European figure. Our extract sits far below that.

The Czech food inspectorate is clear that the percentage is a limit the plant must meet to be used for food at all, not an allowance for how much THC a product may contain. And Czechia prohibits three minor cannabinoids from foods outright, with no permitted trace level. So the generous headline figure is not the whole rule.

Perspectivas

The 1% figure is the most generous in the EU and there is no sign of it being reduced. If anything Czechia has been an outlier in the permissive direction on hemp for several years.

The live risk is the psychoactive-substances schedule rather than the THC percentage. That list is amended readily and has grown repeatedly since it was created in January 2025, and its structure - a natural-trace exemption that is switched off for food - means an addition can convert a full-spectrum product from compliant to prohibited without any threshold being crossed. A draft in early 2025 would have added cannabis extract itself; it was dropped before adoption, but the mechanism remains available.

Watching that list is more useful than watching the 1% figure.

Timeline

September 2021

Zákon č. 366/2021 Sb. of 14 September 2021, in force 1 January 2022, replaces the previous 0.3% THC wording in zákon č. 167/1998 Sb. with a "technical hemp plant" definition of at most 1% THC. Under § 2(1)(a)–(b) as amended, cannabis extract and tincture containing no more than 1% THC is not a narcotic substance. There is no Czech national numeric THC limit for finished foods; SZPI states expressly that the percentage is a limit the plant must meet in order to be used for food production, not a permitted amount in a food.

August 2022

Zákon č. 247/2022 Sb., published 31 August 2022 and in force 1 October 2022, inserts §§ 3b–3d into zákon č. 146/2002 Sb. SZPI may enter a website on a published register by administrative decision under § 3c(1), with the site's operator as a named party and a right of appeal; where the operator cannot be identified they are designated as the domain-name holder and served by public notice. Under § 3d, providers of internet access in Czechia must then block the listed site within 15 days.

November 2024

Zákon č. 321/2024 Sb., published 7 November 2024 and in force 1 January 2025, inserts § 10(1)(h) into the Food Act prohibiting the placing on the market of foods containing psychomodulatory or listed psychoactive substances. Nařízení vlády č. 11/2025 Sb. (in force 17 January 2025) then lists THCP, THCH and THCB, each with a natural-trace exemption for technical hemp that is expressly stated not to apply to food. A food containing even naturally occurring trace amounts of those three cannabinoids is therefore prohibited, with no numeric limb.

November 2025

SZPI enters a "CANNABIS OIL" website (ref. W25-000014-SZPI-CZ) on its register of non-compliant food websites, but does not block it. The entry records that the site is registered outside Czechia, that the domain holder cannot be identified, that hosting is in the USA, and that Czech supervisory authorities' options against the site's operator are, as a result, very limited. The product was promoted as normalising blood sugar, cholesterol, immunity and sleep.
